bitStudio Terms of Service

1. Acceptance of Terms

By accessing or using bitStudio, you agree to be bound by these Terms of Service ("ToS"). If you disagree with any part of the terms, you may not access the service.

2. Description of Service

bitStudio is an intelligent studio where users can upload photos of themselves. These photos are used to train an AI model which is subsequently used to generate high-quality photo shoots. Users should be aware that AI-generated content may contain inaccuracies or unexpected results.

3. Eligibility

You must be at least 18 years old to use bitStudio. By using the service, you represent and warrant that you are at least 18 years of age.

4. User Accounts

4.1. You must create an account with Google to use bitStudio.

4.2. You are responsible for maintaining the confidentiality of your account and password.

4.3. You agree to accept responsibility for all activities that occur under your account.

5. User Content and Responsibilities

5.1. You retain all rights to the photos you upload to bitStudio.

5.2. By uploading photos, you grant bitStudio a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your photos for the purpose of training the AI model and generating photo shoots.

5.3. You represent and warrant that your photos do not violate any third-party rights.

5.4. You are responsible for the content you upload and the use of AI-generated content. You agree not to use the service to create or distribute any illegal, offensive, or harmful content.

6. Acceptable Use

You agree not to use bitStudio for any unlawful purpose or in any way that interrupts, damages, or impairs the service.

7. Payment and Refunds

7.1. Fees for bitStudio services are non-refundable.

7.2. We reserve the right to change our fees at any time.

8. Intellectual Property

The bitStudio service and its original content, features, and functionality are owned by bitStudio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms.

10. Limitation of Liability

10.1. bitStudio and its services are provided "as is" without any warranty.

10.2. In no event shall bitStudio be liable for any indirect, incidental, special, consequential or punitive damages.

10.3. You acknowledge that AI can make mistakes, and bitStudio shall not be held liable for any errors or inaccuracies in the generated photo shoots.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. It is your responsibility to check the Terms periodically for changes.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
